ParentPal PRIVACY NOTICE

This Privacy Notice explains how Teaching Strategies, LLC (“Teaching Strategies,” “our,” “we,” or “us”) handles and treats personal data when you use our website located at GetParentPal.com, TeachingStrategies.com or Tadpoles.com (“Site” or “Website”) or the ParentPal mobile app (“ParentPal” or the “App”). ParentPal and the associated Website are owned and operated by Teaching Strategies. Teaching Strategies makes the following available on the Site and the App. ParentPal provides guidance and assistance to parents and caregivers in the age-appropriate development of children from birth to age five (the “Services”). Teaching Strategies is committed to ensuring and safeguarding the privacy and accuracy of the information collected through the App and Site. This Privacy Notice identifies the information that Teaching Strategies collects from users and visitors of the Site and describes how we will protect, use, share, and otherwise process the information we have collected.

A. WHAT INFORMATION WE COLLECT

ParentPal collects Member Data and Child Data. The Data may include Personally Identifiable Information (PII), which means information that may identify an individual child or Member. ParentPal complies with applicable laws, regulations, industry standards, and contracts and agreements pertaining to the safeguarding of PII. The Data are provided by the Member who has created an account either through a free offer or a purchased subscription and thereby agree to use the Services (an “Member”) or by Authorized Users each Member specifically authorizes to have access to the Member’s family account for only as long as Member deems desirable, which is at the sole discretion of the Member.

User Data is limited information that can be used to personally identify a Member. This information is required before the Member can access the Services (whether on a free basis or through a paid subscription). There are two kinds of personally identifiable User Data:

1. Users; including Members, Authorized Users, teachers, school administrators

    • Email 
    • First name and last name
    • Phone Number (optional)

2. Child records

    • first name, last name

B. HOW WE PROTECT AND SECURE OUR USER’S INFORMATION

We utilize technical, administrative, and physical procedures to ensure Data is protected from unauthorized access, disclosure, or alteration.

You may have the right to restrict or object to the processing of your personal information or to exercise a right to data portability under applicable law.

We have implemented reasonable safeguards designed to prevent loss, misuse and unauthorized access, disclosure or modification of Personal Data provided or collected through the Teaching Strategies Services. With respect to Personal Data collected through the Teaching Strategies Services, we use Secure Socket Layer Technology or SSL to encrypt or scramble that information during transmission and data is encrypted at rest.

In particular:

Data Storage and Security: Secure data centers house all Personal Data. These data centers are continuously monitored and audited annually. 

Disclosures: The uses and disclosures of Personal Data are in compliance with state and federal laws designed to protect such information. Only authorized individuals, including Teaching Strategies employees and subcontractors, have access to Personal Data, and their authorization is constantly reviewed and verified by a cross functional working group, which includes the Information Security Officer and senior Legal and HR staffs. Individuals authorized to have access to Personal Data are limited to only those who need access to that data in order to perform the work necessary under our contractual arrangements with our Subscribers. 

Accountability: All Teaching Strategies employees and subcontractors are accountable for the Security and Privacy of the Personal Data we maintain. This policy applies to all computing systems, networks, business processes, and the verbal transmission of information.

C. HOW WE USE THE INFORMATION WE COLLECT

Only for Authorized Purposes: We only use information we collect for the educational purposes and more support and/or marketing use directly associated with the App for which we were authorized by our Members.

Personal Data: We will use the Personal Data provided to register the membership and to set up and maintain the account.  We may also use the Personal Data to market the service or additional associated services to the Members. We will also use Personal Data to notify Members of updates to the Site and our Services, and for contact purposes if we need more information. If a Member has purchased a subscription through our Website to use the Services, we will use the financial information provided to bill the Member.

If the Member has registered to use the Services through a school, school district, child care center, Head Start program, or other organization that has purchased a subscription from Teaching Strategies, any Personal Data that the Member provides may be accessible by the organizations that purchased the subscription services, as outlined in the contract with the organization.

In the event that circumstances require us to process your personal data for a purpose other than the purpose for which it was collected, we will provide you with information regarding the purpose for the processing, as well as other relevant information, prior to processing your personal data for the new purpose. Please see Section D. below for applicable circumstances.  

 

D. WHEN AND HOW WE SHARE INFORMATION

We share information only for the educational, marketing and support purpose of the work. We do not share Personal Data for advertising or any other use outside of the stated purpose for the Service. 

We will not sell or distribute personally identifiable user information or data collected from use of this resource.

We vigilantly review our policies and practices to ensure compliance where required with the Federal Educational Rights and Privacy Act (FERPA) and the European Union’s General Data Protection Regulation (GDPR) and applicable state law and regulations. We will not disclose any of the Personal Data we collect to any third parties except as described in C above and in the following limited circumstances:

Disclosures that are necessary to carry out the scope of work. We may use subcontractors to carry out functions within the scope of work when it is in compliance with GDPR, federal, and state law and with applicable agreements. In such circumstances, the subcontractor is acting as a Teaching Strategies employee and is required to comply with the privacy and security requirements and safeguards that apply to Teaching Strategies and all of its employees. This includes all applicable federal laws, state laws and regulations, contractual agreements, and applicable Subscriber policies.

Our accountability for personal information we receive under the Privacy Shield and subsequently transferred to a third party is described in the Privacy Shield Principles. In particular, we may use third parties to process data on our behalf as described in this Privacy Policy, and we remain liable if they do so in a manner inconsistent with the Privacy Shield Principles, unless we prove that we are not responsible for the event giving rise to the damage.

Legally compelled disclosures. We will disclose the data we collect if required to do so by law or in the good-faith belief that disclosure is necessary (a) to obey the law or comply with legal process served on us or our affiliates; (b) to protect and defend our rights or property or the rights or property of other users of our Web site; or (c) to act in an emergency to protect the personal safety of users of our website or the public.

Company acquisition. In the event that our company is acquired, we may share the data with the acquirer to continue to provide services to you. The acquirer will be bound by this Privacy Policy, and we will comply with all contractual agreements with our Subscribers that require us to disclose any acquisition of Teaching Strategies.

Analytics.  We may work with third parties that collect data about your use of the Site and other sites or apps over time for non-advertising purposes.  For example, Teaching Strategies uses Google Analytics to improve the performance of the Site and for other analytics purposes.  For more information about how Google Analytics collects and uses data when you use our Site, visit https://www.google.com/policies/privacy/partners/ , and to opt out of Google Analytics, visit https://tools.google.com/dlpage/gaoptout/.

We do not sell or rent your data: Teaching Strategies, LLC does not sell or rent any data that has been collected through the Services.

E. INTERNATIONAL VISITORS

This section applies to those who visit our Site from the European Economic Area or Switzerland.

Lawful Basis for Processing

On certain occasions, we process your personal data when it is necessary for the performance of a contract to which you are a party, such as to provide services to you that you have requested.  We may also process your personal data to respond to your inquiries concerning our products and services.

On other occasions, we process your personal data where required by law.  We may also process your personal data if necessary, to protect your interests or the interests of a third party.

Additionally, we process your personal data when it becomes necessary for us to provide important notifications to Subscribers concerning the Services. We will also use your personal data to communicate with you if you choose to opt into our marketing communications so that you can learn more about our Services and products. However, this interest in providing you with information does not override your data protection rights.  Where we process your personal data for this purpose, our legitimate interest is to improve our Services and secure our Site.

If the processing of personal data is necessary and there is no statutory basis for such processing, we will ask for your consent to process your personal data.  You have the right to withdraw your consent to processing of personal data at any time. Transfers of Personal Data

Please be aware that the personal data we collect may be transferred to and maintained on servers or databases located outside your state, province, country, or other jurisdiction, where the privacy laws may not be as protective as those in your location. If you are located outside of the United States, please be advised that we process and store personal data in the United States.

Teaching Strategies complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States. Teaching Strategies has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Complaints Resolution

In compliance with the Privacy Shield Principles, Teaching Strategies commits to resolve complaints about our collection or use of your personal information. EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Teaching Strategies at DPO@teachingstratgies.com.

Teaching Strategies has further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgement of your complaint from us, or if we have not addressed your complaint to your satisfaction, please visit https://www.jamsadr.com/ for more information or to file a complaint. The services of JAMS are of no cost to you.

If your concern still is not addressed by JAMS you may be entitled to a binding arbitration under the Privacy Shield Principles. For purposes of enforcing compliance with the Privacy Shield, Teaching Strategies is subject to the investigatory and enforcement authority of the U.S. Federal Trade Commission.

Your Rights

You have a right to the following:

  • To request access to the personal data we hold about you;
  • To request that we rectify or erase your personal data;
  • To request that we restrict or block the processing of your personal data;
  • Under certain circumstances, to receive personal data about you that we store and transmit to another without hindrance from us, including requesting that we provide your personal data directly to another (i.e., a right to data portability); and
  • Where we previously obtained your consent, to withdraw consent to processing your personal data.

To exercise these rights, contact our Data Protection Officer. (Please see the “Contact” section below.)  Please be aware that Teaching Strategies may be unable to afford these rights to you under certain circumstances, such as if we are legally prevented from doing so.

Additionally, you have the right to lodge a complaint against us.  To do so, contact the supervisory authority in your country of residence.

F. RETENTION

We will process and store your information only for the period necessary to achieve the purpose of the storage, or as permitted by law.  

G. WE DO NOT COLLECT INFORMATION FROM CHILDREN

Our Services are not intended to be accessed by anyone under 16 years of age. We respect the sensitive nature of children’s privacy online. The Services are intended for use by schools, school districts, program administrators, teachers, parents, and legal guardians. They are not intended for use by persons under the age of 16. We do not expect and are not aware of children under the age of 16 accessing our site, and we are in full compliance with the legal requirements outlined in COPPA regarding children under the age of 13. If we learn that a Member is under 16 years of age, we will promptly delete any personally identifiable information provided by that user.

H. HOW USERS CAN CORRECT THEIR INFORMATION

Users can manage the data they entered: Our Members are able to manage and modify the information that they provide to us. They may correct or change any of their Personal Data by logging onto the site and updating or correcting their Personal Data. Members may change any of the Personal Data that they provide by logging onto the Services and modifying the applicable data. If you need assistance modifying your Personal Data, you may contact ParentPal’s support services at support@GetParentPal.com.

External links: The Site may contain links to other Web sites or refer our users to other resources. We are not responsible for the privacy practices or the content of such Web sites or resources, and our users should refer to such Web sites and resources for information about how such sites and resources protect the information they collect.

J. DATA TRACKING

Tracking Information: We use the anonymous information we collect to administer our Site, improve our services, determine how the Site is being used, identify popular areas of the Site, and analyze trends and usage patterns. We may use the IP address of our Members to help diagnose problems with our server. 

K. CHANGES TO OUR PRIVACY POLICY

Teaching Strategies may modify or update this Privacy Policy from time to time. We encourage you to review this page periodically. If we change the policy in a material manner, such as using personal data in a different way than prior practice, we will provide at least a 30-day notice to our Members so that they will have sufficient time to evaluate the change in practice.

L. DISCLAIMER OF LIABILITY

The information contained herein reflects the privacy policy and practices that Teaching Strategies has adopted for the Site. In legal terms, it shall not be construed as a contractual promise, and Teaching Strategies reserves the right to amend it at any time in accordance with Section K above. Any such amendment will become effective, with a 30-day notice, as stated in Section K above. Neither Teaching Strategies nor any of its affiliates, employees, or agents shall be held liable for any improper or incorrect use of the information described and/or contained in the Site and assumes no responsibility for anyone’s use of the information.

ParentPal TERMS OF USE

1. Introduction

1.1 Contract

When you use our Services you agree to all of these terms. Your use of our Services is also subject to our Privacy Policy, which covers how we collect, use, share, and store your personal information.

You agree that by clicking “Join Now”, “Join ParentPal”, “Sign Up” or similar, registering, accessing or using our services (described below), you are agreeing to enter into a legally binding contract with Teaching Strategies, Inc. If you do not agree to this contract (“Contract”), do not click “Join Now” (or similar) and do not access or otherwise use any of our Services. If you wish to terminate this contract, at any time you can do so by closing your account and no longer accessing or using our Services. Payments are nonrefundable and any refunds or credits for partially used periods will be given at our discretion.

You are entering into this Contract with Teaching Strategies, Inc. (also referred to as “Teaching Strategies”, “we” and “us”).

This Contract applies to Members and Authorized Users. As a Member or Authorized User of our Services, the collection, use and sharing of your personal data is subject to this Privacy Policy and updates.

1.2 Services

This Contract applies to ParentPal.com, the ParentPal app, and other ParentPal-related sites, apps, communications and other services that state that they are offered under this Contract (“Services”), including the collection and use of data for those Services, such as our external marketing campaigns. Registered users of our Services are “Members” and those team members invited into a Member’s family team are “Authorized Users”. 

1.3 Members and Authorized Users

When you register and join the ParentPal Service, you become a Member. Members may extend access to their accounts to third parties (“Authorized Users”). Members are responsible for any actions taken by their Authorized Users.  Members can withdraw and delete an Authorized User’s account access at any time. 

1.4 Change

We may modify this Contract and our Privacy Policy from time to time. If we make material changes to it, we will provide you notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. We agree that changes cannot be retroactive. If you object to any changes, you may close your account. Your continued use of our Services after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms as of their effective date.

2. Obligations

2.1 Service Eligibility

To be eligible for the Services, you promise that: 

  • You’re eligible to enter into this Contract and you are at least our “Minimum Age.” “Minimum Age” means 16 years old. However, if law requires that you must be older in order for Teaching Strategies to lawfully provide the Services to you without parental consent (including using of your personal data) then the Minimum Age is such older age. The Services are not for use by anyone under the age of 16.
  • You will only have one ParentPal account, which must be in your real name. 
  • You are not already restricted by ParentPal or Teaching Strategies from using the Services. 
  • You will provide true and accurate information when creating your account. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 16.

Teaching Strategies reserves the right to restrict, suspend, or terminate your account if you breach this Contract or the law or are misusing the Services (e.g., violating any related policies).

2.2 Your Account

Members are account holders. You agree to: (1) use a strong password and keep it confidential; (2) not transfer any part of your account (e.g., connections) and (3) follow the law. You are responsible for anything that happens through your account unless you close it or report misuse.

As between you and others (including your Authorized Users), your account belongs to you. However, if you are an Authorized User and the Services were purchased by another party for you to use, the party paying for such Service has the right to control access to and get reports on your use of such paid Service; however, they do not have rights to your personal account. 

2.3 Payment 

Except in instances where Teaching Strategies offers you a free subscription, either as a recipient of a complementary subscription through the Buy One, Give One program, through a partner of Teaching Strategies who is providing your subscription to you free of charge with approval by Teaching Strategies, or during a time when Teaching Strategies decides to provide some or all Members free subscriptions (such as during a period of time related to the COVID-19 crisis), each Member will have access to a free usage period before the chosen paid subscription period begins. During this free trial period, you can cancel your subscription before any payment is incurred. 

You’ll honor your payment obligations, and if you choose to purchase your subscription through ParentPal or Teaching Strategies directly (e.g. through the ParentPal or Teaching Strategies websites, as opposed to through the Apple or Google app stores) you are okay with us storing your payment information to facilitate your recurring payment obligations. Your payment method will be automatically charged at the start of each subscription period for the fees and taxes applicable to that period. To avoid future charges, cancel before the renewal date of the term you select during your purchase (either monthly or annual).  Failure to honor your payment obligations will result in the termination of your paid Services and loss of stored data. All of your purchases of Services are subject to ParentPal’s refund policy.

2.4 Notices and Messages

You agree that we will provide notices and messages to you in the following ways: (1) within the Service, or (2) sent to the contact information you provided us (e.g., email, mobile number, physical address). You agree to keep your contact information up to date.

Please review your settings to control and limit messages you receive from us.

2.5 Sharing 

Our Services allow Members and Authorized Users to message and share information (including photos, completed activities and milestones) in many ways, such as through your profile, message boards, messages, and to external social media platforms. Information and content that you share or post may be seen, used or copied by other Members, Authorized Users or others (including off of the Services). We will honor the choices you make about who can see content or information. 

We are not obligated to publish any information or content you share on our Service and can remove it with or without notice.

3. Rights

3.1. Your License to Teaching Strategies

You own all of the content, feedback and personal information you provide to us, but you also grant us a non-exclusive license to it, so that we can host it on our message boards as you direct us to do through the app sharing features, for instance. We will not use your content for external purposes without your permission. See our Privacy Policy for further information on how we use your content and personal information.  

You own the content and information that you submit or post to the Services, and you are only granting Teaching Strategies and our affiliates the following non-exclusive license in order to provide the Services to you and your Authorized Users:

A worldwide, transferable and sublicensable right to use, copy, modify, distribute, publish and process, information and content that you provide through our Services and the services of others, without any further consent, notice and/or compensation to you or others to facilitate our provision of the Services to you, like internal and external message board functionality. These rights are limited in the following ways: 

  • You can end this license for specific content by deleting such content from the Services, or generally by closing your account, except (a) to the extent as part of the Service you shared it on an external social media site or an internal message board or with others and this content was copied, re-shared or stored by others, and (b) for the reasonable time it takes to remove from backup and other systems upon your request for us to do so. 
  • We will not include your content in advertisements for the products and services of third parties without your separate consent (including sponsored content). We will get your consent if we want to give others the right to publish your content beyond the Services. However, if you choose to share your post as “public”, we will enable a feature that allows other Members to embed that public post onto third-party services, and we enable search engines to make that public content findable though their services. 
  • Because you own your content and information and we only have non-exclusive rights to it, you may choose to make it available to others, including under the terms of a Creative Commons license.

You and Teaching Strategies agree that if content includes personal data, it is subject to our Privacy Policy.

You and Teaching Strategies agree that we may access, store, process and use any information and personal data that you provide in accordance with, the terms of the Privacy Policy and your choices (including settings).

By submitting suggestions or other feedback regarding our Services to Teaching Strategies, you agree that Teaching Strategies can use and share (but does not have to) such feedback for any purpose without compensation to you.

You promise to only provide information and content that you have the right to share and that does not violate the law or anyone’s rights (including intellectual property rights), and that your ParentPal profile will be truthful.

3.2 Service Availability

We may change or end any Service or modify our prices prospectively upon reasonable notice.

3.3 Other Content, Sites and Apps 

Your use of others’ content and information posted on our Services, is at your own risk.

We may link to third party products and services (like Amazon) through our Services, and we aren’t responsible for those third-parties or for third-party products or services purchased outside of the Service, even if required to use the Services.  

By using the Services, you may encounter content or information provided by other Members that might be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. Teaching Strategies generally does not review content provided by our Members or others. You agree that we are not responsible for others’ (including other Members’) content or information. We cannot always prevent this misuse of our Services, and you agree that we are not responsible for any such misuse. 

3.4 Intellectual Property Rights

We’re providing you notice about our intellectual property rights.

Teaching Strategies reserves all of its intellectual property rights in the Services. Trademarks and logos used in connection with the Services are the trademarks of their respective owners. The ParentPal brand, and its logos and other trademarks, service marks, graphics and logos used for our Services are trademarks or registered trademarks of Teaching Strategies.

3.5 Automated Processing 

We use the information and data that you provide and that we have about Members to make recommendations for connections, content and features that may be useful to you and your child(ren). For example, we use data and information about your child’s age to suggest appropriate activities and routines each day. Keeping your profile accurate and up to date helps us to make these recommendations more accurate and relevant.

4. Disclaimer and Limit of Liability

4.1 No Warranty

This is our disclaimer of legal liability for the quality, safety, or reliability of our Services.

TEACHING STRATEGIES AND ITS AFFILIATES MAKE NO REPRESENTATION OR WARRANTY ABOUT THE SERVICES, INCLUDING ANY REPRESENTATION THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, AND PROVIDE THE SERVICES (INCLUDING CONTENT AND INFORMATION) ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, TEACHING STRATEGIES AND ITS AFFILIATES DISCLAIM ANY IMPLIED OR STATUTORY WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF TITLE, ACCURACY OF DATA, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

4.2 Exclusion of Liability

These are the limits of legal liability we may have to you.

TO THE FULLEST EXTENT PERMITTED BY LAW (AND UNLESS TEACHING STRATEGIES HAS ENTERED INTO A SEPARATE WRITTEN AGREEMENT THAT OVERRIDES THIS CONTRACT), TEACHING STRATEGIES, INCLUDING ITS AFFILIATES, WILL NOT BE LIABLE IN CONNECTION WITH THIS CONTRACT FOR LOST PROFITS OR LOST BUSINESS OPPORTUNITIES, REPUTATION (E.G., OFFENSIVE OR DEFAMATORY STATEMENTS), LOSS OF DATA (E.G., DOWN TIME OR LOSS, USE OF, OR CHANGES TO, YOUR INFORMATION OR CONTENT) OR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES.

TEACHING STRATEGIES AND ITS AFFILIATES WILL NOT BE LIABLE TO YOU IN CONNECTION WITH THIS CONTRACT FOR ANY AMOUNT THAT EXCEEDS (A) THE TOTAL FEES PAID OR PAYABLE BY YOU TO TEACHING STRATEGIES FOR THE SERVICES DURING THE TERM OF THIS CONTRACT, IF ANY, OR (B) US $1000.

4.3 Basis of the Bargain; Exclusions

The limitations of liability in this Section 4 are part of the basis of the bargain between you and Teaching Strategies and shall apply to all claims of liability (e.g., warranty, tort, negligence, contract and law) even if Teaching Strategies or its affiliates has been told of the possibility of any such damage, and even if these remedies fail their essential purpose.

These limitations of liability do not apply to liability for death or personal injury or for fraud, gross negligence or intentional misconduct, or in cases of negligence where a material obligation has been breached, a material obligation being such which forms a prerequisite to our delivery of services and on which you may reasonably rely, but only to the extent that the damages were directly caused by the breach and were foreseeable upon conclusion of this Contract and to the extent that they are typical in the context of this Contract.

5. Termination

We can each end this Contract, but some rights and obligations survive.

Both you and Teaching Strategies may terminate this Contract at any time with notice to the other. On termination, you lose the right to access or use the Services. The following shall survive termination:

  • Our rights to use and disclose your feedback;
  • Members and/or Authorized Users’ rights to view and further re-share content and information you shared through the Services; 
  • Sections 4, 6, 7, and 8.2 of this Contract;
  • Any amounts owed by either party prior to termination remain owed after termination.

6. Governing Law and Dispute Resolution

In the unlikely event we end up in a legal dispute, you and Teaching Strategies agree to resolve it in Delaware courts using Delaware law. 

This section shall not deprive you of any mandatory consumer protections under the law of the country to which we direct Services to you, where you have your habitual residence. 

7. General Terms

Here are some important details about the Contract.

If a court with authority over this Contract finds any part of it unenforceable, you and we agree that the court should modify the terms to make that part enforceable while still achieving its intent. If the court cannot do that, you and we agree to ask the court to remove that unenforceable part and still enforce the rest of this Contract.

This Contract (including additional terms that may be provided by us when you engage with a feature of the Services) is the only agreement between us regarding the Services and supersedes all prior agreements for the Services.

If we don’t act to enforce a breach of this Contract, that does not mean that Teaching Strategies has waived its right to enforce this Contract. You may not assign or transfer this Contract (or your membership or use of Services) to anyone without our consent. However, you agree that Teaching Strategies may assign this Contract to its affiliates or a party that buys it without your consent. There are no third-party beneficiaries to this Contract.

You agree that the only way to provide us legal notice is at the addresses provided in Section 10.

8. ParentPal “Dos and Don’ts”

8.1. Dos

This list of “Dos and Don’ts” limit what you can and cannot do on our Services.

You agree that you will:

  • Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements;
  • Provide accurate information to us and keep it updated;
  • Use your real name on your profile; and
  • Use the Services in a professional manner.

8.2. Don’ts

You agree that you will not:

  • Create a false identity on ParentPal, misrepresent your identity, or use or attempt to use another’s account without permission;
  • Develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, browser plugins and add-ons or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services;
  • Override any security feature or bypass or circumvent any access controls or use limits of the Service (such as caps on keyword searches or profile views);
  • Copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties (such as search engines), without the consent of Teaching Strategies;
  • Disclose information that you do not have the consent to disclose (such as confidential information of others (including your employer));
  • Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights. For example, do not copy or distribute (except through the available sharing functionality) the posts or other content of others without their permission, which they may give by posting under a Creative Commons license;
  • Violate the intellectual property or other rights of Teaching Strategies, including, without limitation, (i) copying or distributing our learning videos or other materials or (ii) copying or distributing our technology, unless it is released under open source licenses; (iii) using the word “ParentPal” or our logos in any business name, email, or URL;
  • Post anything that contains software viruses, worms, or any other harmful code;
  • Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology that is not open source;
  • Imply or state that you are affiliated with or endorsed by Teaching Strategies without our express consent;
  • Rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without Teaching Strategies’ consent;
  • Deep-link to our Services for any purpose other than to promote your profile or a Group on our Services, without Teaching Strategies’ consent;
  • Use bots or other automated methods to access the Services, add or download contacts, send or redirect messages;
  • Monitor the Services’ availability, performance or functionality for any competitive purpose;
  • Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services;
  • Overlay or otherwise modify the Services or their appearance (such as by inserting elements into the Services or removing, covering, or obscuring an advertisement included on the Services);
  • Interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms); and/or
  • Violate any additional terms concerning a specific Service that are provided when you sign up for or start using such Service.

9. Complaints Regarding Content

Contact support@getparentpal.com for complaints about content provided by our Members. 

We respect the intellectual property rights of others. We require that information posted by Members be accurate and not in violation of the intellectual property rights or other rights of third parties. We provide a policy and process for complaints concerning content posted by our Members.
